Our Terms and Conditions

ARTICLE 1 — COMPANY IDENTIFICATION

BOEM ADVENTURE, a single-member limited liability company with a capital of 5,000 euros, registered with the Fréjus Trade and Companies Register under number 100 707 553, with its principal place of business located at 155 Avenue des Arènes – 83700 Saint-Raphaël, represented by Marion PREVOT in her capacity as Manager.

ARTICLE 2 — PURPOSE

These General Terms and Conditions of Sale (GTC) govern all services offered by BOEM ADVENTURE: sports and cultural days, organized road trips, customized experiences, corporate events, team-building activities, and participant transportation.

Any reservation implies full, complete, and unconditional acceptance of these GTC.

ARTICLE 3 — ASSUMPTION OF RISKS AND PHYSICAL FITNESS

The activities offered by BOEM ADVENTURE are primarily physical and outdoor activities that involve inherent risks.

The customer acknowledges:
- participating voluntarily
- accepting normal and foreseeable risks
- being physically fit for the sport
- having no medical contraindications
- knowing how to swim when the activity requires it (particularly kayaking)

BOEM ADVENTURE reserves the right to refuse or exclude any participant whose condition could compromise their personal safety or that of the group, without any refund being required.

ARTICLE 4 — RESERVATION

The reservation becomes firm and final after:
- written confirmation of the quote
- acceptance of the Terms and Conditions
- payment of the total amount or a deposit.

BOEM ADVENTURE reserves the right to refuse any reservation that could compromise the safety or proper organization of the service.

ARTICLE 5 — RATES

Prices are listed in euros, including tax, and cover only the services specified in the offer or quote.

Unless otherwise stated, the following are never included:
- personal insurance
- personal expenses
- optional extras
- services not specified

Rates are subject to change at any time without affecting confirmed reservations.

ARTICLE 6 — PAYMENT TERMS

Individual customers: Full payment is required at the time of booking.

Business customers:
- 50% deposit upon signing
- Balance due 30 days before the event

Any late payment will result in:
- Immediate payment of the outstanding balance
- Suspension or cancellation of the service


ARTICLE 7 — CUSTOMER CANCELLATION POLICY

Applicable rates:
Cancellation of reservation:
More than 7 days: full refund
Less than 7 days: 100% retained
Change of reservation dates:
More than 7 days before the event: Possible if availability exists on the new date selected
Any service that has begun is due in full.

For professional events, the number of participants provided 7 days before the event is considered final and will be billed.

ARTICLE 8 — CANCELLATION OR MODIFICATION BY BOEM ADVENTURE

BOEM ADVENTURE may cancel or modify a service in the event of:
- hazardous weather conditions (Météo France)
- force majeure
- administrative decision
- natural hazards
- safety concerns
- failure to meet the minimum number of participants

In this case, the customer may choose between:
- priority rescheduling
- a credit note for the amount of the service valid for 12 months + a 30% discount voucher on another BOEM ADVENTURE purchase.
- or a full refund

No additional compensation may be claimed.

ARTICLE 9 — WEATHER

Since outdoor activities depend on natural conditions, unfavorable weather does not constitute grounds for cancellation by either the customer or BOEM ADVENTURE. Only conditions posing a proven danger (as determined by Météo France) may result in a modification or postponement without this constituting a breach of contract.

ARTICLE 10 — PROGRAM CHANGES

BOEM ADVENTURE reserves the right to modify itineraries, schedules, activities, or service providers when circumstances require it.

The customer acknowledges and accepts this flexibility, which is inherent to outdoor activities.

ARTICLE 11 — CONDUCT OF PARTICIPANTS

Each participant agrees to behave respectfully and to follow safety instructions.

BOEM ADVENTURE may immediately exclude any person who is:
- intoxicated
- under the influence of drugs
- aggressive
- endangering others
- endangering the group

This exclusion will not result in any refund.

ARTICLE 12 — TRANSPORTATION

When the service includes transportation, it is provided in accordance with the regulations governing the road transport of passengers.

Requirements:
- wearing a seatbelt
- respecting the vehicle
- no illegal substances

BOEM ADVENTURE reserves the right to refuse access to the vehicle to anyone whose condition is incompatible with safety.
Any damage caused to the vehicle will be billed.

ARTICLE 13 — CUSTOMER DELAY

Any delay on the part of the customer at the day’s departure point will not result in:
- any extension
- any refund
- any discount

The service may be shortened without compensation.

ARTICLE 14 — EQUIPMENT

The equipment provided must be used for its intended purpose. Any damage caused intentionally or through negligence will be billed to the customer.

ARTICLE 15 — INSURANCE AND PERSONAL BELONGINGS

BOEM ADVENTURE has professional liability insurance.

Participants remain responsible for their personal belongings.
BOEM ADVENTURE cannot be held liable for any loss, theft, or damage.
Personal insurance is strongly recommended.

ARTICLE 16 — MINORS

Minors remain the sole responsibility of their legal guardians.
Parental consent may be required.

ARTICLE 17 — LIMITATION OF LIABILITY

BOEM ADVENTURE’s liability is strictly limited to the value of the service sold.

BOEM ADVENTURE shall not be held liable for indirect damages such as loss of business, commercial loss, or loss of opportunity.

ARTICLE 18 — INDEPENDENCE OF SERVICE PROVIDERS

BOEM ADVENTURE may engage independent contractors. Each contractor remains responsible for their own legal and insurance obligations.

ARTICLE 19 — FORCE MAJEURE

BOEM ADVENTURE shall not be held liable for any failure to perform its obligations in the event of unforeseeable and unavoidable circumstances, such as natural disasters, strikes, civil unrest, pandemics, government-mandated closures, or major accidents.

ARTICLE 20 — DATA PROTECTION

Personal data is used solely for the purpose of managing services.
In accordance with the GDPR, customers have the right to access, correct, and delete their personal data.

ARTICLE 21 — CONSUMER MEDIATION

In accordance with Articles L.612-1 et seq. of the Consumer Code, individual customers may seek the assistance of a consumer mediator free of charge to resolve a dispute amicably.

ARTICLE 22 — PARTIAL INVALIDITY

If any provision of these Terms and Conditions is found to be invalid, the remaining provisions shall remain in full force and effect.

ARTICLE 23 — GOVERNING LAW AND DISPUTES

These Terms and Conditions are governed by French law.

In the event of a dispute:
- Priority shall be given to attempting an amicable resolution
- Failing that, the courts within the jurisdiction of the company’s registered office shall have exclusive jurisdiction.
